Protection against illegal and parallel import

This complicated border area of the law is regulated mainly by the Mark and Geographic Indications Act 1999, the Protection of Competition Act 1998, the Industrial Design Act 1999 and the Regulation for border control measures for protection of intellectual property rights 2000.

We assist clients in defending their intellectual property rights in cases of importation of infringing goods, materials or articles. We provide a detailed analysis of all legal options that clients usually have in such cases – to mention but a few – civil action for damages or recognition of trade mark rights, criminal action for passing off, action for imposing fines by the Commission for the Protection of competition or measures for customs border control.
